Terms of use

Last updated November 4, 2026

These terms cover the games made by Warm Valley Games, LLC ("we" or "us") and this website. By playing our games or using this site, you agree to these terms and to our privacy policy. If you don't agree, please don't use them.

We may update these terms from time to time. The newest version is always on this page, with the date it changed. If you keep playing after a change, you agree to the new terms.

Playing our games

  • Our games are for players of all ages. Parents decide whether and how their kids play.
  • We give you a personal, non-transferable, non-exclusive license to play our games for your own noncommercial use.
  • Please don't copy, change, resell, reverse engineer, or redistribute our games or their art, music, or code, except where the law allows it.
  • We may change, pause, or stop offering any game or feature at any time.

Purchases

  • Some content is unlocked with an in-app purchase. Every purchase goes through the App Store or Google Play and follows their terms. Prices are set in each store and may change.
  • Apple and Google handle billing and refunds. We can't issue refunds ourselves, so please ask them.
  • Purchases belong to the Apple or Google account you bought them with. You can restore them on another device signed in to that account.

Your game data

Your progress is saved on your device. If you delete a game or lose your device, your progress may be lost, and we can't get it back for you.

Please play fair

Don't use our games or this site to break the law, to hurt or harass anyone, or to share anything that isn't yours. Don't try to hack, overload, or get around how our games and servers work, and don't use bots or scrapers on them. If a game lets you share something you made, keep it kind.

What's ours

Our games and this site, including their names, logos, art, music, and code, belong to Warm Valley Games, LLC or the people we license from. Apple, the App Store, Google Play, and other trademarks belong to their owners. We keep every right these terms don't give you.

Apple and Google

These terms are between you and us, not Apple or Google. They aren't responsible for our games or for supporting them. If you got a game from the App Store, Apple's Licensed Application End User License Agreement also applies, and Apple and its subsidiaries may enforce these terms as third-party beneficiaries. If you got it from Google Play, Google Play's terms also apply.

No warranty

We work hard on our games, but we provide them and this site "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, including merchantability, fitness for a particular purpose, title, and noninfringement. We don't promise that our games will be free of bugs or always available.

Limits on our liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or progress, that come from using or not being able to use our games or this site. Our total liability to you is limited to what you paid for the game in question in the 12 months before your claim. Some places don't allow these limits, so they may not all apply to you.

If someone makes a claim

If you break these terms or someone else's rights, and another person makes a claim against us because of it, you agree to cover our reasonable costs, including attorneys' fees.

Ending your access

You can stop using our games at any time by deleting them. We may end your access if you break these terms. The sections on what's ours, no warranty, limits on our liability, claims, and law and disputes still apply after that.

Law and disputes

These terms are governed by the laws of the State of Texas and of the United States, without regard to conflict-of-laws rules. Any dispute goes to the state or federal courts located in Travis County, Texas. Where the law allows, a claim must be brought within one year after it arises. None of this takes away consumer rights you have where you live.

Outside the United States

We run our games and this site from the United States. If you play from somewhere else, you're responsible for following your local laws, and you may not export our games in violation of US export laws.

Everything else

These terms are the whole agreement between you and us about our games and this site. If part of them can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given it up. You can't transfer these terms to someone else, but we can. We may give you notice on this site or in our games.
